Do you know how to properly prepare a client (and material) for a "fresh asylum/human rights claim"? Poor quality preparation often leads to "Further Submissions" being rejected by the Home Office and this can put you in a worse position than before. A "fresh claim" is not just arguing the client's case in a better way – there has to be evidence that is new and credible to support the legal arguments advanced. But when does "new" material create a realistic prospect of success on a fresh asylum claim under para 353? The trainer, Mavelyn Vidal, with her over 24 years' experience in asylum and human rights law, will explore the reasons why it is so hard to succeed in a "fresh claim" matter and will provide practical tips on increasing the chances of success.
Case examples will be used to highlight recurring problems and best practice. There will be opportunities for discussion
This training is aimed at OISC immigration advisers' level 3 and solicitors who have little or no experience in fresh claim application but are keen to develop their skills in this particular area.
Mavelyn has extensive knowledge on the subject. Her practice includes both written and oral advocacy in the Tribunals, Administrative Court and the Court of Appeal. She has also taught law subjects since 1988.
The focus of the course will be on the practical steps involved in preparing a fresh claim for persons seeking asylum and human rights protection. Topics covered are:
• Brief legal background to asylum and fresh claims
• Merits of pursuing a fresh claim and alternative options
• Practical tips (or things to avoid) for preparation of fresh claims
• The contents of submissions in support of a fresh claim
• Considering the Secretary of State's decisions on a fresh claim
• Challenging a negative decision by the Secretary of State
Objectives: At the end of the training delegates will have a greater understanding of the complexities of the process of applying for a Fresh Claim and be in a better position to advise and prepare their clients.
