This course is suitable for those sitting the OISC competence assessment at Level 2 and the Law Society accreditation exam at Level 1. It will provide delegates with an understanding of the main aspects of immigration and asylum law and practice. Please note that due to the ground covered by the course the trainer will move at a fairly intense pace. The course will include the substantive knowledge AND the skills required to pass the OISC competence assessments and accreditation exams; it will also focus on those aspects of law and policy which are most topical and therefore more likely to be encountered in examinations and practice.

Edward Mynott is an OISC-regulated practising Tribunal Advocate in the First-tier and Upper Tribunal, and a member of the Law Society's Immigration Law Advanced Accreditation Scheme. He has been working in the field of immigration for over 15 years, has an extensive knowledge on all aspects of practice and regularly delivers training on all aspects of immigration law.

Course content

  • overview of UK immigration control; entry clearance, leave to enter and remain – the main categories of entry and stay under the Immigration Rules – working in the UK under the Point Based System and leave outside the rules;
  • the rights of refugees and those with discretionary leave/humanitarian protection to family reunion etc;
  • asylum application procedures;
  • application of the European Convention of Human Rights to UK immigration decisions, absolute and qualified rights, the incorporation of Article 8 into the immigration rules and relevant case law;
  • paragraph 320 – dealing with the general grounds for refusal and re-entry bans;
  • enforcement of immigration control – offences; illegal entry and overstaying; new offences under 2016 Act; liability to administrative removal and deportation;
  • detention and bail; powers of detention; how to secure release through bail from a CIO;
  • entitlement to British citizenship and the right of abode; acquiring citizenship through registration/naturalisation/ discretionary applications;
  • rights of appeal; time limits; appeal procedures;
  • EEA nationals and their rights under EU law; the rights of family members who are third country nationals; procedures relating to residence documents and family permits; advising in the shadow of Brexit.
