HJT: Human Rights | Preparing Human Rights Claims and Preparing Appeals

Preparing Human Rights Claims and Presenting Appeals

These days every aspect of running a human rights case is fraught with difficulty – choosing the right form for an application, drafting persuasive representations, advising on the chances of an in-country appeal, certification and loss of appeal rights for being a “clearly unfounded” or “repeat” claim,  ever-more complicated legal tests to understand on appeal, and the tactical considerations about what to emphasise and what to leave out. We deal with these issues and more, addressing:

  • Overstayers and private life
  • When is residence truly precarious?
  • Spouses and insurmountable obstacles
  • Reasonableness and children
  • Public interest considerations
  • Human rights claims wholly outside the Rules
  • Family proceedings concurrent with immigration appeals
  • Non-suspensive appeals
  • Preparing an appeal
  • Persuasive advocacy
  • Judicial review of human rights refusals without the right of appeal
