HJT - Judicial Review for OISC, Solicitors & Barristers

This course about immigration judicial review is useful for any immigration practitioner wishing to master the key principles and procedures.

We are concentrating on judicial review proceedings brought in the Upper Tribunal, as these proceedings are most relevant to most immigration practitioners, whose clients are often confronted with a decision that does not attract a right of appeal. We will cover the fundamentals and the key procedures, including:

-Procedures in the Upper Tribunal

-Where to lodge: Upper Tribunal or Administrative Court

-Time Limits  

-Drafting the judicial review grounds – arguing errors of law

-The Judicial Review Process from Pre Action Protocol letter to substantive hearing

-General procedural issues – duties of disclosure and candour, Hamid hearings, fresh decisions and amending grounds, imminent removal processes, and costs
